Third, agreements between the EC and third countries or international organizations are negotiated by the commission, but the authorization by the Council is required for the opening of negotiation, and finally it is the Council that has power to take the decision whether or not to conclude any agreement. Article 228(1) provides that: "where this treaty provides for the conclusion of agreements between the community and or more states or international organizations, the commission shall make recommendations to the Council ,which shall authorize the commission to open the necessary negotiations appointed by the Council to assist it in this task and within the framework of such directives as the Council may issue to it. "The power of the Council in respect of the acceptance of new obligations for the community in international law are the corollary of its role in the internal legislative sphere.
Finally, the Council''s power in the budgetary field is more limits than in the legislative field .The effect of financial treaty of 1970 and 1975 was to establish a clear-cut distinction between the allocation of legislative power, on the one hand, and budgetary power , on the other hand: the right to finally on the expenditure necessarily resulting from the treaty or from acts adopted in accordance with "compulsory expenditure" belong to the Council , while the European parliament has the right to decide "non-compulsory expenditure ".At the time when the distinction between compulsory and non-compulsory expenditure was first introduced, agricultural expenditure was by far the most significant element of the budget, but that situation has changed : the proportion of the budget account for by non-compulsory expenditures has risen sharply , and so has the political significance of expenditure on the structural funds and financial co-operation with third countries, with a corresponding increase in the European parliament''s power. However ,it must be stressed that the provision of resources heeded to finance community expenditure involves the exercise of legislative powers , not budgetary. In accordance with Article 201 EC , the procedure laid down for the creation of the communities'' own resources culminates in a decision by the Council , which has the to be recommended to the member states for adoption in accordance with their respective constitutional requirements.
