1974年国际海上人命安全公约1983年修正案(附英文)

  2 使用吊艇索和绞车的降落设备
  2.1 吊艇索应是防旋转及耐腐蚀的钢丝索。
  2.2 除设置有效的补偿装置者外,对于多卷筒绞车,吊艇索的布置应使在降落时,以相同的速率从各卷筒卷出,并在吊起时,以相同的速率均匀地卷到各卷筒上。
  2.3 每具救助艇降落设备应装设动力驱动的绞车电机,该电机的功率能从水中吊起载足全部乘员及属具的救助艇。
  2.4 应设有收回每艘救生艇筏和救助艇的有效的手动装置。在救生艇筏和救助艇下降时,或使用动力吊起时,绞车的转动部分应不使手动装置手柄或手轮旋转。
  2.5 凡使用动力收回吊艇架吊臂者,应装设安全装置,在吊艇架吊臂回到原位限制器之前要自动地切断动力,以防止吊艇索或吊艇架受到过度应力,而电机的设计是能防止此过度应力者除外。
  2.6 救生艇筏或救助艇降落下水的速度,应不小于由下列公式得出的速度:
  s=0.4+(0.02×H)
  式中:s=下降速度(以m/s计)
  并且 H=从吊艇架顶部到最轻载航行水线的距离(以m计)。
  2.7 考虑救生艇筏或救助艇的设计、保护乘员免受过度力以及计入应急制动过程中的惯性力的降落装置强度后,主管机关应制定最大下降速度。在该降落设备中应并入其它设施,以确保不超过此速度。
  2.8 每具救助艇降落设备应能以不小于0.3m/s的速度吊起载足全部救助艇乘员及属具的救助艇。
  2.9 每具降落设备应设有制动器,使载足全部乘员及属具的救生艇筏或救助艇在降落中能刹住并可靠地系留住;凡有必要者,制动带应加防水和防油的保护。
  2.10 手控制动器的布置,应始终处于制动状态,除非操作者或操作者操作的机械装置把制动控制保持在“脱开”的位置上。
  3 自由漂浮下水
  凡救生艇筏需要降落设备并设计为自由漂浮者,救生艇筏从其存放地点自由漂浮应是自动的。
  4 自由降落下水
  除符合本条之1中适用的要求外,每具使用斜面的自由降落下水设备尚应符合下列要求:
  .1 该降落设备的布置应使救生艇筏的乘员在降落过程中不致感受到过度力。
  .2 该降落设备应是具有足够斜角和长度的刚性结构,保证救生艇筏有效地离开船舶。
  .3 该降落设备应加有效防腐蚀保护,而且其构造在救生艇筏降落过程中应防止发生摩擦起火或碰击火花。
  5 撤离滑梯降落和登乘
  除符合本条之1适用的要求外,每具撤离滑梯降落设备尚应符合下列要求:
  .1 撤离滑梯应能由1个人在登乘位置展开;
  .2 撤离滑梯应能在强风和海浪中使用。
  6 救生筏降落设备
  考虑利用重力旋出降落设备,在存放地点登乘并收回满载的救生筏者除外,每具救生筏降落设备应符合本条之1和2的要求。该降落设备的布置,应防止在降落过程中过早脱开,并应使救生筏在水平面时脱开。
  7 登乘梯
  7.1 应设有扶手以确保一条从甲板到登乘梯顶部或相反方向的安全通道。
  7.2 登乘梯的踏板:
  .1 应采用没有节疤或其他凹凸不平外形的硬质木料制成,而且加工平滑并无锐利棱边和毛刺,或采用其他等效性质的适用材料制成;
  .2 应具有有效的防滑表面,可以采用纵向槽纹,也可以敷铺认可的防滑涂层;;
  .3 其长度应不少于480mm,宽度应不少于115mm,并且厚度应不少于25mm,防滑表面或涂层除外;
  .4 间距应相等,间隔不少于300mm,也不大于380mm,并且其系固方法要使其保持水平状态。
  7.3 登乘梯每边的边绳应由两根裸露的白棕绳组成,其周长不小于65mm。每根边绳在顶端踏板之下应为整根而无接头。可以采用其它材料,但尺度、破断应力、风化性能、伸缩性能和紧握性能均须至少相当于白棕绳的性能。所有绳端均应扎牢以防松散。

             第Ⅶ节 其它救生设备

  第49条 抛绳设备
  1 每具抛绳设备应:
  .1 能相当准确地将绳抛射出;
  .2 包括不少于4个抛绳体,每个能在无风天气中将绳抛射至少230m远;
  .3 包括不少于4个根抛射绳,每根抛射绳具有破断张力不少于2kN;
  .4 备有简要说明书或图解阐明抛绳设备的用法。
  2 手枪发射的火箭,或火箭与抛射绳组成整体的组件,应装在防水的外壳内。此外,对于手枪发射的火箭,抛射绳和火箭以及引燃器材应贮存在抗风雨的容器内。
  第50条 通用紧急报警系统
  通用紧急报警系统应能以船舶号笛或警笛,并另加以由船舶主电源及第Ⅱ-1/42条或第Ⅱ-1/43条所要求的应急电源(如果适合)供电的电动铃或小型振膜电警笛或其他等效警报系统,发出由7个或7个以上的短声继以1长声组成的通用紧急报警信号。鸣响船舶号笛除外,该系统应能自船舶驾驶室和其他要害位置进行操作。全船所有起居处所及船员正常工作处所均应能听到该系统的报警。

               第Ⅷ节 其他

  第51条 训练手册
  训练手册可分成若干分册,此手册应包括关于船上所配备的救生设备和最佳救生方法的须知和资料,用易懂措词(凡有可能者加以图解)进行说明。这些资料的任何部分都可以用视听辅助教材形式来代替。下列各项应加详细解释:
  .1 救生衣与救生服的穿着法(如果适用);
  .2 在指定地点集合;
  .3 救生艇筏和救助艇的登乘、降落和离开;
  .4 在救生艇筏内降落的方法;
  .5 从降落设备上脱开;
  .6 降落区域内防护方法与防护设备的用法(如果适用);
  .7 降落区域的照明;
  .8 一切救生属具的用法;
  .9 一切探测装备的用法;
  .10 (用图解说明)无线电救生设备的用法;
  .11 海锚的用法;
  .12 发动机及辅助设备的用法;
  .13 救生艇筏和救助艇的回收(包括存放和制牢);
  .14 暴露的危险和穿用保暖衣服的必要性;
  .15 为求生,救生艇筏设备的最佳用法;

  第52条 船上维护保养须知
  救生设备的船上维护保养须知应是易懂的,凡有可能应加以图解说明,并且如果适用,每种设备应包括下列各项:
  .1 进行第19.7条所要求的检验时所用的核对表;
  .2 维护保养与修理须知;
  .3 定期维护保养计划表;
  .4 润滑点示意图,并注明建议用的润滑剂;
  .5 可替换部件一览表;
  .6 备件来源一览表;
  .7 检验和维护保养记录簿。
  第53条 应变部署表与应变须知
  1 应变部署表应写明第50条所规定的通用紧急报警信号的细则,并应规定发出警报时船员和旅客必须采取的行动。应变部署表尚应写明弃船命令将如何发出。
  2 应变部署表应写明分派给各种船员的任务,包括:
  .1 船上水密门、防火门、阀门、排水孔、船舷小窗、天窗、舷窗和其他类似开口的关闭;
  .2 救生艇筏和其他救生设备的装备;
  .3 救生艇筏的准备工作和降落;
  .4 其他救生设备的一般准备工作;
  .5 集合旅客;
  .6 通信设备的用法;
  .7 指定处理火灾的消防队人员的配备;
  .8 指定有关使用消防设备及装置方面的专门任务。
  3 应变部署表应指明那些驾驶员负责保证维护救生和消防设备使其处于良好状态,并立即可用。
  4 应变部署表应指明关键人员受伤后的替换者,要考虑不同应变情况要求不同的行动。
  5 应变部署表指明在应变时,指定给船员的与旅客有关的各项任务。这些任务应包括:
  .1 向旅客告警;
  .2 查看旅客是否适当地穿好衣服,以及是否正确地穿好救生衣;
  .3 召集旅客于各集合地点;
  .4 维持通道及梯道上的秩序,并一般地控制旅客的动向;
  .5 保证把毛毯送到救生艇筏上。
  6 应变部署表应在船舶开航以前制定。在应变部署表制定后,如船员有所变动而必须更改应变部署表时,船长应修订该表,或者制定新表。
  7 客船用应变部署表的格式应经认可。

            第Ⅳ章 无线电报与无线电话

  第2条 名词与定义
  增加下列新款:
  “(i)‘应急无线电示位标’系指用于移动业务的电台,其发射的电波旨在便于搜寻和救助作业。”
  增加下列新条:
  “第14-1条 救生艇应急无线电示位标
  (a)第Ⅲ/6.2.3条要求在救生艇筏上配备的救生艇筏应急无线电示位标应发射能使航空器测定救生艇筏位置的电波,并可发射用于报警目的电波。
  (b)救生艇筏应急无线电示位标应至少能在121.5MHz和243.0MHz频率上,交替发射或同时发射符合国际民用航空组织(ICAO)有关标准和推荐惯例的信号。
  (c)救生艇筏应急无线电示位标应:
  (i)颜色显而易见,其设计应能使非熟练人员使用,其构造应易于试验和维修。在考虑到安排试验的情况下,电池组在12个月内应无须更换;
  (ii)水密、能够飘浮,而且能从高度至少为20m处投入水中而不致损坏;
  (iii)只能人工启动和停止;
  (iv)便于携带、重量轻而且结构坚实;
  (v)设有表明正在发射信号的指示器;
  (vi)其能源系来自与装置组成一个整体的并具有足够容量使该装置工作48h的电池。发射可为间歇性的。在确定其工作周期时,应考虑在进行正常自动搜索时的搜索概率,必需避免在频率使用上产生拥挤以及必需符合国际民用航空组织(ICAO)的要求;
  (vii)进行试验,并如必要时,应在不超过12个月的时间内更换其能源。
  第14-2条 应急无线电示位标的定期检验和试验
  按照第Ⅲ/6.2.3条配备的应急无线电示位标应在不超过12个月的时间内进行检查和试验,如果必要,更换其能源。但是,在适当和合理的情况下,主管机关可把此时间延长至17个月。
  第14-3条 救生艇筏用双向无线电话设备
  (a)第Ⅲ/6.2.4条所要求的设备的设计应能使非熟练人员在紧急情况下使用。
  (b)该设备应便于携带,并能用于船上通信。
  (c)该设备应符合无线电规则中有关用于海上移动业务的船上通信设备的要求,并应能在《无线电规则》所规定的和主管机关所要求的那些频道上工作。如果该设备在甚高频波段内进行工作,应采取措施防止能在甚高频16频道上进行工作的设备误选该频道进行工作。
  (d)该设备应使用具有足够容量的电池,保证在负载比为1:9的情况下,工作4h。
  (e)当船舶在海上时,该设备应保持处于良好状态,而且在必要时,应将电池充足电或者换新。”

          第Ⅶ章 危险货物运输(替代文本)

          A部分 包装或固体散装危险货物运输

  第1条 适用范围
  1 除另有明文规定外,本部分适用于现行条款所适用的一切船舶以及小于500总吨货船运输的包装或固体散装形式的、按本部分第2条分类的危险货物(以下简称危险货物)。
  2 本部分的规定不适用于船用物料和设备。
  3 除非符合本部分的规定,禁止运输危险货物。
  4 为补充本部分的规定,各缔约国政府应颁布或促使颁布关于危险货物安全包装及积载的细则,该细则应包括与其他货物有关的必要预防措施①。
  ①参阅本组织A.81(Ⅳ)决议通过的《国际海上危险货物运输规则》(IMDG规则)以及本组织A.434(Ⅺ)决议通过并已由海上安全委员会修正的《固体散装货物安全操作规则》(BC规则)附录B的有关部分和有关章节。
  第2条 分类
  危险货物应分为如下的类别:
  1类 爆炸品
  2类 压缩、液化或加压溶解的气体
  3类 易燃液体
  4.1类 易燃固体
  4.2类 易于自然的物质
  4.3类 遇水产生易燃气体的物质
  5.1类 氧化剂
  5.2类 有机过氧化物
  6.1类 有毒的(毒性的)物质
  6.2类 感染性物质
  7类 放射性物质
  8类 腐蚀性物质
  9类 杂类危险物质(即经验经已证明或可能证明按其危险性质必须应用本部分规定的任何其他物质)。
  第3条 包装
  1 危险货物的包装应是:
  .1 坚固而完好
  .2 包装的内表面可能与货物相接触者,应不致受所装货物的严重影响;
  .3 能经受得住装卸及海运的一般危险。
  2 如包装液体容器按常例采用具有吸收性或减震性的材料时,此种材料应为:
  .1 能减少此液体可能引起的危险;
  .2 其布置应能防止移动,并确保该容器保持围衬状态;
  .3 如为合理与可能,应具有足够的数量,以便在容器万一破裂时能吸收液体。
  3 装盛危险液体的容器,应在灌注温度下留有在正常装运过程中最高温度所需的足够膨胀空隙。
  4 压缩气体的盛瓶或容器,应为构造合适、经过试验、维护良好以及正确充灌者。
  5 除非已经采用适当的措施以消除任何危险性,曾用于装运危险货物的未清洗的空容器,应按本部分关于灌装容器的规定处理。
  第4条 标记、标志和标志牌
  1 盛装危险货物的包装件,应以正确的学名(不应单独使用商业名称)加以耐久标记。
  2 危险货物包装件应根据需要,加上明显的标志或签条板或标志牌,以表明所装盛的货物的危险性质。
  3 在危险货物包装件上标学名、贴标志可加签条板或固定标志牌的方法,应该是包装件上的内容在海中浸没至少3个月后依然可以辨认。在考虑采用合适的标记、标志和标志牌时,应考虑到所用材料的耐久性和包装件的表面。
  4 危险货物包装件应照此加以标记和标志,但是:
  .1 危险程度低或包装数量有限的危险货物包装件①,或
  .2 特殊情况许可时,用标志或标志牌识别的成组堆放和装卸的包装件①,可以免除标志要求。
  ①参考《国际海上危险货物运输规则》(IMDG规则)中所规定的特殊免除。
  第5条 单据
  1 在有关海运危险货物的所有单据中,货物名称应使用正确学名(不应单独使用商业名称)并按本部分第2条所列类别加以正确说明。
  2 由托运人预备的托运单据,应包括或附有经签署的证明书或声明书,注明所交运的货物业已按情况需要正确地作了包装、标记、标志或加上了标志牌,并处于合适的装运状态。
  3 每一艘装运危险货物的船舶,须具有按照本部分第2条的分类规定载明船上所装危险货物及其位置的特殊清单或舱单。标明所有危险货物的类别并注明其在船上位置的详细配载图,可以代替此特殊清单或舱单。
  第6条 堆装要求
  1 危险货物应按其性质安全地和适当地予以堆装。性质互不相容的货物,应彼此分开。
  2 具有严重危险性的爆炸品(弹药除外),应堆装于在航行中须保持严密封闭的火药库内。这类爆炸品应与雷管分开。装运爆炸品的任何舱室内的电气设备及电缆,其设计与使用应能使火灾或爆炸的危险减至最小程度。
  3 会产生危险蒸气的包装危险货物,应堆装于机械通风的处所或甲板上。会产生危险蒸气的散装固体危险货物,应堆装于通风良好的处所。
  4 装运易燃液体或易燃气体的船舶,在有必要防止火灾或爆炸的处所,应采取特殊的预防措施。
  5 在未经采用足够的预防措施以减小火灾发生的可能性以前,不得装运易于自热或自燃的物质。
  第7条 客船上的爆炸品
  1 在客船上仅可装运如下爆炸品:
  .1 安全弹药和安全引信;
  .2 总净重不超过10kg的少量爆炸品;
  .3 船舶或航空器使用的遇险信号,其总重量不超过1000kg者;
  .4 不致发生猛烈爆炸的花炮,但装运统舱无床位旅客的船舶除外。
  2 虽在本条之1有所规定,但在具有经主管机关认可的特殊安全措施的客船上,可载运额外数量或其他类型的爆炸品。

       B部分 散装运输危险液态化学品船舶的构造和设备

  第8条 定义
  除另有明文规定外,在本部分中:
  1 “国际散化规则”系指本组织海安会决议MSC.4(48)通过的《国际散装运输危险化学品船舶构造和设备规则》,此规则可能由本组织进行修正,但此项修正应是根据现行公约第Ⅷ条适用于附则(第Ⅰ章除外)的有关修正程序通过、生效并实施的。
  2 “化学品液货船”系指建造或改建用于运输《国际散化规则》第17章所列的任何液体产品的货船。
  3 在第9条内,“建造船舶”系指安放龙骨或处于相应建造阶段的船舶。
  4 “处于相应建造阶段”是指在这样的阶段:
  .1 可辨认出某一具体船舶建造开始;且
  .2 该船业已开始的装配量至少为50t或为所有结构材料估算重量的1%,以较小者为准。
  第9条 化学品液货船的适用范围
  1 除另有明文规定外,本部分适用于1986年7月1日或以后建造的化学品液货船,包括小于500总吨者。此类化学品液货船除符合本公约附则任何其他可适用的要求外,也应符合本部分的要求。
  2 任何化学品液货船,不论其建造日期如何,当进行修理、改装、改建以及与之有关的舾装时,至少应继续符合该船原先适用的要求。这种船舶如系在1986年7月1日之前建造者,一般应至少达到该船在进行修理、改装、改建或舾装之前,已经履行该日期及以后建造船舶要求的同等程度。重大的修理、改装、改建以及与之有关的舾装,在主管机关认为合理和可行的范围内,应满足对1986年7月1日或以后建造船舶的要求。
  3 不论其建造日期如何,当船舶改建成化学品液货船时,应作为在该船改建开始之日建造的化学品液货船处理。
  第10条 对化学品液货船的要求
  1 化学品液货船应符合《国际散化规则》的要求,并且除了符合本公约附则第Ⅰ/8条、第Ⅰ/9条和第Ⅰ/10条的规定以外,还要根据该规则进行检验及发证。在本条范围内,该规则的要求作为强制性要求处理。
  2 持有根据本条之1要求所发证书的化学品液货船,应接受本公约附则第Ⅰ/19条所确定的监督。为此,此项证书应被作为按照附则第Ⅰ/12条或第Ⅰ/13条的要求而签发的证书看待。

        C部分 散装运输液化气体船舶的构造和设备

  第11条 定义
  除另有明文规定外,在本部分中:
  1 “国际液化气船规则”系指本组织海安会决议MSC.5(48)通过的《国际散装运输液化气体船舶构造和设备规则》,此规则可能由本组织进行修正,但此项修正应是根据现行公约第Ⅷ条适用于附则(第Ⅰ章除外)的有关修正程序通过、生效并实施的。
  2 “液化气船”系指建造或改建用于运输《国际液化气船规则》第19章所列的任何散装液化气体或其他物质的货船。

CHAPTER II-1 CONSTRUCTION-SUBDIVISION AND STABILITY, MACHINERY
ANDELECTRICAL INSTALLATIONS

Chapter II-1 of the Convention is replaced by the text of Chapter II-1
annexed to resolution MSC.1 (XLV), further amended as follows:

Regulation 1 Application

In paragraph 1.1 line 3 delete "1 September 1984" and insert "1 July
1986".

In paragraph 1.3.2 line 2 delete "1 September 1984" and insert "1 July
1986".

Replace the whole of paragraph 2 by:

"Unless expressly provided otherwise, for ships constructed before 1
July 1986 the Administration shall ensure that the requirements which are
applicable under Chapter II-1 of the International Convention for the
Safety of Life at Sea, 1974, as amended by resolution MSC.1 (XLV), are
complied with."

Delete the footnote.

In paragraph 3 lines 4 and 9 delete "1 September 1984" and insert "1
July 1986".

Delete paragraph 5 and renumber paragraph 6 as paragraph 5.

Regulation 3 Definitions relating to Parts C, D and E

Amend paragraph 19 as follows:

"`Chemical tanker'' is a cargo ship constructed or adapted and used for
the carriage in bulk of any liquid product listed in either:

.1 Chapter 17 of the International Code for the Construction and
Equipment of Ships Carrying Dangerous Chemicals in Bulk adopted by the
Maritime Safety Committee by resolution MSC.4 (48), hereinafter referredto as `the International Bulk Chemical Code'', as may be amended by the
Organization; or

.2 Chapter VI of the Code for the Construction and Equipment of
Ships Carrying Dangerous Chemicals in Bulk adopted by the Assembly of the
Organization by resolution A. 212 (VII), hereinafter referred to as `theBulk Chemical Code'', as has been or may be amended by the Organization;
Whichever is applicable."

Amend paragraph 20 to read:

"`Gas carrier'' is a cargo ship constructed or adapted and used for the
carriage in bulk of any liquefied gas or other products listed in either:

.1 Chapter 19 of the International Code for the Construction and
Equipment of Ships Carrying Liquefied Gases in Bulk adopted by the
Maritime Safety Committed by resolution MSC.5 (48) hereinafter referred to
as `the International Gas Carrier Code'', as may be amended by the
Organization; or

.2 Chapter XIX of the Code for the Construction and Equipment of
Ships Carrying Liquefied Gases in Bulk adopted by the Assembly of the
Organization by resolution A. 328 (IX), hereinafter referred to as `the
Gas Carrier Code'', as has been or may be amended by the Organization;

whichever is applicable."

Regulation 5 Permeability in passenger ships

Amend paragraph 4.1 to read:

"4.1 In the case of special subdivision required in regulation 6.5,
the uniform average permeability throughout the portion of the ship
forward of or abaft the machinery space shall be 95-35 b/v where:

b = the volume of the spaces below the margin line and above the
tops of floors, inner bottom, or peak tanks, as the case may be, which are
appropriated to and used as cargo spaces, coal or oil fuel bunkers,
storerooms, baggage and mail rooms, chain lockers and fresh water tanks,forward of or abaft the machinery space; and

v = the whole volume of the portion of the ship below the margin
line forward of or abaft the machinery space."

Regulation 6 Permissible length of compartments in passenger ships

Replace the heading of section 5 by "Special subdivision standards for
ships complying with regulation III/20.1.2."

Insert new paragraphs 5.3 and 5.4 as follows:

"5.3 The special provisions regarding permeability given in regulation
5.4 shall be employed when calculating the floodable length curves.

5.4 Where the Administration is satisfied that, having regard to the
nature and conditions of the intended voyages compliance with the other
provisions of this chapter and of chapter II-2 is sufficient, the
requirements of this paragraph need not be complied with."

Regulation 41 Main source of electrical power and lighting systems

Paragraph 1.3, line 3 insert "of rotation" after "direction".

Regulation 42 Emergency source of electrical power in passengerships

Amend sub-paragraph 2.1.1 to read:

".1 at every muster and embarkation station and over the sides as
required by regulations III/11.4 and III/15.7".

Insert new sub-paragraph 2.1.2 to read:

".2 in alleyways, stairways and exits giving access to the muster and
embarkation stations, as required by regulation III/11.5".

Renumber sub-paragraphs 2.1.2 to 2.1.7 to read 2.1.3 to 2.1.8.

Paragraph 2.3.4 line 2 delete "manual fire alarms" and insert
"manually operated call points".

Regulation 43 Emergency source of electrical power in cargo ships

Amend paragraph 2.1 to read:

"2.1 For a period of 3 h, emergency lighting at every muster and
embarkation station and over the sides as required by regulations III/11.4
and III/15.7."

Paragraph 2.4.4, line 2 delete "manual fire alarms" and insert
"manually operated call points".

Regulation 49 Control of propulsion machinery from the navigatingbridge
Paragraph 3, line 6 delete "the machinery space" and insert "the main
machinery space"

delete "the machinery control room" and insert "the main machinery
control room".

Paragraph 5, line 3 insert "of the propeller" after "thrust."

Paragraph 6.1, line 1 delete "in case" and insert "in the case".

Ships Carrying Dangerous Chemicals in Bulk adopted by the Assembly of the
Organization by resolution A.212 (VII), hereinafter referred to as `the

Paragraph 31 amend to:

"`Gas carrier'' is a tanker constructed or adapted and used for the

entire length and breadth of the part of the ship over the above-mentioned
spaces."

Regulation 4 Fire pumps, fire mains, hydrants and hoses

In paragraph 3.3.2.6 line 3 delete "room" and insert "station".
