2. 除了特批进行周转性借款,附件1中的宪法性机构不得借款和对外担保
3. 主要公共机构(Major Public Entities)、其他公共机构(Other Public Entities)、前述两种类型公共机构之外的其他公共机构,三种主体举债适用不同的要求。比较而言,附件2中的主要公共机构享有较大的管理自主权;附件3中的自主性相比较小。
4. 省级政府、省级公共机构不得进行外汇形式的或者国际金融市场形式的对外借款,对外保证或提供担保或进行可能使其自身受财务承诺约束的交易。
5. 附件3之外的省级政府企业不得对外借款或对外提供担保。
6. 国有独资企业对外进行外汇借款有限额限制。
最后,建议在具体项目中通过南非当地执业律师出具法律意见,确认举债程序或对外担保程序符合南非当地法律要求。
