【注释】《联合国宪章》第53条第1款规定：“如无安全理事会之授权，不得依区域办法或由区域机关采取任何执行行动。”
《联合国宪章》第43条第1款要求会员国“担任于安全理事会发令时，并依特别协定，供给为维持国际和平及安全所必须之军队、协助及便利”；第2款要求特别协定应就军队的数目、种类、驻扎地点等做出详细规定；第三款规定“此项协定应由安全理事会与会员国或由安全理事会与若干会员国之集团缔结之，并由签字国各依其
宪法程序批准之”。
朝鲜战争涉及所谓“联合国军”的问题，但它在宪章的依据上存在着极大的争议。
有一些学者承认事后默示授权的合法性，但局限在区域组织使用武力的情况下，这是基于对《宪章》第七章和第八章第53条的不同解释，他们认为区域组织可以在宪章53条下行使武力，只要安理会有明确指出构成危害国际和平安全，并且没有明确地否定进行干涉，就可以不需要安理会的预先的明示授权使用武力。
