但是,无论是移植还是借鉴美国的商业外观法律制度,都不仅需要对被移植或借鉴的具体成文法律规定和判例法中的原则作深入研究,探讨其获得成功的原因,分析其存在的缺陷与不足,还要对我国传统法律文化与法律资源作必要的梳理、清理与检讨,并就移植或借鉴的法律制度与中国社会的具体情况的相容性及其社会效果作深入的反省和考察。
