论版权管理电子信息的立法保护
The Legislative Protection of Electronic Information through Administrating of Copyright

【摘要】版权管理电子信息是随着国际互联网发展的新形势而由权利人采取的保护版权和邻接权的措施，破坏该信息会导致直接侵犯版权行为的大量产生，禁止破坏版权管理电子信息成为世界知识产权组织和现代各国最新版权立法的重要内容。本文在综合考察世界知识产权有关国际条约和先进国家版权立法中对版权管理电子信息基础上，对我国著作权立法中如何正确界定版权管理电子信息、破坏版权管理电子侵权行为的认定及其立法完善提出了作者的建议。
The electronic information through administrating of copyright is a countermeasure adopted by an obligee to protect their copyrights and neighboring rights with the development of new situation of the Internet. The infringement of the electronic information will cause a gross violation of the copyright. Prohibiting of violating the administration of electronic information has become one of the essential countermeasures by the World Intellectual Property Right Organization and the international legislatures in the world today. The thesis, based on the comprehensive research on some relevant international conventions concerning world property rights protection and legislation on the copyright in the developed countries, brings forth some propositions on the following aspects according to the statue quo in China: distinguish correct demarcation of the electronic copyright administration, how to determine the violation of the electronic copyrights and how to protect relevant legislation on the violation of the electronic copyrights administration.

一、版权管理电子信息的界定
版权管理信息有两种基本分类方法。依管理权利的不同种类划分，可分为著作权管理信息和邻接权管理信息。根据《世界知识产权组织版权条约》第12条第2款规定，版权管理信息是指识别作品、作品的作者、对作品拥有任何权利的所有人的信息，或有关作品使用的条款和条件的信息，和代表此种信息的任何数字或代码，各该项信息均附于作品的每件复制品上或在作品向公众进行传播时出现；[1]根据《世界知识产权组织表演和唱片条约》第19条第2款规定，邻接权管理信息是指识别邻接权主体（如表演者、录音制作者等）、邻接权保护对象（如表演者的表演、录音制品等）或对邻接权保护对象拥有任何权利的所有人的信息，或有关使用邻接权保护对象的条款和条件的信息，和代表此种信息的任何数字或代码，各该信息均附于邻接权保护对象的复制品上或在这些保护对象向公众提供时出现。[2]依版权管理信息的存在形态划分，又可分为版权管理电子信息和版权管理非电子信息两类。前者又称为数字形态的版权管理信息，应用于网络环境；后者又称为非数字形态的版权管理信息，体现为文字编码，主要应用于非网络环境下的著作权或邻接权管理。我国著作权立法规范的版权管理信息仅指版权管理电子信息，其根本立法宗旨是解决网络环境中的著作权保护问题，协调网络环境中作者、其他著作权人、邻接权人和网络用户之间的利益关系。
