<劳动法>第33、34、35条
《经社文公约》第8条规定如下:
一、 本公约缔约国承允确保:
(a) 人人有权为促进及保障其经济及社会利益而组织工会及加入其自身选择之工会,仅受关系组织规章之限制。除依法律之规定,且为民主社会维护国家安全或公共秩序,或保障他人权利自由所必要者外,不得限制此项权利之行使;
(b) 工会有权成立全国联合会或同盟,后者有权组织或参加国际工会组织;
(c) 工会有权自由行使职权,除依法律之规定,且为民主社会维护国家安全或公共秩序,或保障他人权利自由所必须要者外,不得限制此种权利之行使;
(d) 罢工权利,但以其行使符合国家法律为限;
二、 本条并不禁止对军警或国家行政机关人员行使此种权利,加以合法限制。
